Who is eligible for the EB2-NIW?

You may qualify if you have an advanced degree (Master’s, Doctorate, or a Bachelor’s degree with at least 5 years of progressive work experience in your field); or demonstrate exceptional ability in your field through awards, certifications, years of experience, and significant contributions to your industry.

What is considered “exceptional ability”?

To prove exceptional ability, you must meet at least three of the following: a degree, diploma, or certificate in your area of expertise; letters documenting at least 10 years of full-time experience; a license or certification to practice your profession; evidence of a high salary or other remuneration; membership in professional associations; or recognition for your achievements and contributions in your field.

Do I need a job offer to apply for the EB2-NIW?

No. The EB2-NIW waives the requirement for a job offer. You can apply independently as long as you prove your work is in the national interest of the U.S.

Does the EB2-NIW cover my family?

Yes, your spouse and unmarried children under 21 can be included in the application. They will receive Green Cards if your petition is approved.

What documents are required for the application?

Each case is unique, but common documents include degrees and academic transcripts, letters of recommendation from employers or peers, evidence of professional achievements, and certificates of experience and contributions to your field.

How long does the EB2-NIW process take?

The USCIS typically takes 12 to 24 months to process an EB2-NIW petition. You can also apply for work and travel authorizations for you and your family during this time.

Can I apply for the EB2-NIW from outside the U.S.?

Yes, you can apply from abroad. After approval, you and your family will go through consular processing at the appropriate Embassy or Consulate before receiving your Green Cards.

What is premium processing? Can I use it for the EB2-NIW?

Yes, premium processing is available for an additional fee. The USCIS will process your case (or request additional evidence) within 45 calendar days.

Does premium processing increase my chances of approval?

No. Premium processing only speeds up the response time but does not increase or decrease your likelihood of approval.

How long is an EB2-NIW Green Card valid?

The Green Card is valid for 10 years and provides permanent residency. After 5 years of residency, you may be eligible to apply for U.S. citizenship.
